Please read these Terms of Service ("Terms") carefully before using the LociStamp mobile application (the "App" or "Service") provided by Yong Wang ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the Terms then you may not access the Service.
1. License to Use
1.1 Grant of License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on mobile devices that you own or control, solely for your personal, non-commercial purposes.
1.2 Restrictions
You may not:
- Copy, modify, or distribute the App
- Reverse engineer, decompile, or disassemble the App
- Rent, lease, lend, sell, or sublicense the App
- Use the App for any unlawful purpose
- Remove any proprietary notices from the App
2. Subscriptions and Purchases
2.1 In-App Purchases
The App offers optional premium features through in-app purchases managed by the Apple App Store.
2.2 Subscription Terms
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel your subscriptions by going to your App Store account settings after purchase
- Any unused portion of a free trial period will be forfeited when you purchase a subscription
2.3 Pricing
- Subscription prices are displayed in your local currency
- Prices may vary by region and are subject to change
- Price changes will not affect active subscription periods
2.4 Refunds
All purchases are processed through Apple. Refund requests must be submitted to Apple according to their refund policy. We do not have the ability to process refunds directly.
3. User Content
3.1 Your Content
You retain all rights to the photos, videos, and other content you create using the App ("User Content"). We do not claim any ownership over your User Content.
3.2 Responsibility
You are solely responsible for:
- The content you create, edit, and share using the App
- Ensuring you have the right to use any images, logos, or text you incorporate
- Compliance with applicable laws regarding the content you create
3.3 Prohibited Content
You agree not to use the App to create content that:
- Infringes on intellectual property rights of others
- Contains illegal material
- Is defamatory, obscene, or offensive
- Violates any person's privacy or publicity rights
- Contains malware or harmful code
4. Intellectual Property
4.1 App Ownership
The App, including its original content, features, and functionality, is owned by Yong Wang and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
4.2 Templates and Assets
Any templates, designs, or assets provided within the App are licensed for use within the App only. You may use them in content you create but may not extract or redistribute them separately.
4.3 Feedback
Any feedback, comments, or suggestions you provide regarding the App is entirely voluntary, and we are free to use such feedback without any obligation to you.
5. Disclaimer of Warranties
5.1 "As Is" Basis
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.
5.2 No Guarantee
We do not guarantee that:
- The App will meet your specific requirements
- The App will be uninterrupted, timely, secure, or error-free
- The results obtained from using the App will be accurate or reliable
- Any errors in the App will be corrected
5.3 Use at Your Own Risk
Your use of the App is at your sole risk. You are responsible for any damage to your device or loss of data that results from using the App.
6. Limitation of Liability
6.1 No Liability for Damages
To the maximum extent permitted by applicable law, in no event shall Yong Wang, its affiliates, directors, employees, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
6.2 Maximum Liability
Our total liability to you for all claims arising from or related to the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $50 USD, whichever is greater.
6.3 Exclusions
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.
7. Indemnification
You agree to defend, indemnify, and hold harmless Yong Wang and its licensors from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Content you create using the App
8. Termination
8.1 Your Right to Terminate
You may stop using the App at any time by deleting it from your device.
8.2 Our Right to Terminate
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.
8.3 Effect of Termination
Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.
9. Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of material changes by posting the new Terms within the App.
Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.
11. Dispute Resolution
11.1 Informal Resolution
Before filing a claim, you agree to try to resolve the dispute informally by contacting us at [email protected].
11.2 Binding Arbitration (Where Permitted)
Where permitted by applicable law, if informal resolution fails, any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property infringement.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
13. Entire Agreement
These Terms constitute the entire agreement between you and Yong Wang regarding your use of the App and supersede any prior agreements.
14. Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
15. Apple-Specific Terms
15.1 Acknowledgment
You acknowledge that these Terms are between you and Yong Wang only, not with Apple, and Apple is not responsible for the App or its content.
15.2 Scope of License
The license granted to you is limited to a non-transferable license to use the App on Apple-branded products that you own or control as permitted by the App Store Terms of Service.
15.3 Maintenance and Support
Yong Wang, not Apple, is solely responsible for providing any maintenance and support services for the App.
15.4 Warranty
Yong Wang, not Apple, is responsible for any product warranties, whether express or implied by law.
15.5 Product Claims
Yong Wang, not Apple, is responsible for addressing any user or third-party claims relating to the App.
15.6 Third-Party Beneficiary
Apple and its subsidiaries are third-party beneficiaries of these Terms, and Apple will have the right to enforce these Terms against you.
